Digital Knowledge Co Terms and Conditions
Public courses and bookings
Effective date: 13 April 2026
These Terms apply to bookings for Digital Knowledge Co public courses. They should be read with the course page, booking page, and any invoice or confirmation email. Nothing in these Terms excludes, restricts or modifies rights that cannot lawfully be excluded under the Australian Consumer Law.
1. Contracting party
- These Terms are issued by XOOT Pty Ltd (ACN 125 614 842), trading as Digital Knowledge Co ("DKC", "we", "us", "our").
- By booking, requesting an invoice, or attending a course, you agree to these Terms.
2. Course bookings and payment
- All prices are in Australian dollars and are exclusive of GST unless stated otherwise.
- A booking is confirmed when payment is received, or when we confirm acceptance of an invoice or purchase order arrangement.
- For invoice bookings, payment is due within 7 days of invoice issue or before the course start date, whichever is earlier.
- We may refuse, suspend or cancel a booking if payment is overdue.
3. Course changes, transfers and substitutions
- You may nominate a substitute attendee at no extra charge by giving us notice before the course starts.
- If you cancel 10 or more business days before the course, you may choose either a refund or a transfer to another available public session.
- If you cancel 5 to 9 business days before the course, you may transfer once to another available public session, but no refund is available.
- If you cancel fewer than 5 business days before the course, or do not attend, no refund is payable.
4. Changes by DKC
- We may change the course date, time, facilitator, platform, or delivery format where reasonably necessary.
- If we cancel or materially reschedule a course and the revised arrangement is not suitable for you, you may choose:
- A full refund; or
- A transfer to another available public session of the same course at no additional charge; or
- Subject to availability, a transfer to a different public course, in which case any price difference will be charged or refunded as applicable.
- Our liability for a cancelled or rescheduled course is limited to the course fee paid, except where the Australian Consumer Law applies.
5. Course delivery and attendance
- Public courses are delivered live online unless stated otherwise.
- Attendees are responsible for having suitable internet access, a working device, and any software or platform access specified in advance.
- We may remove an attendee without refund if their behaviour is abusive, discriminatory, disruptive, unlawful, or creates a risk to others or to the course.
6. Materials, recordings and intellectual property
- Course materials, templates, canvases, slides and related content remain our intellectual property unless we state otherwise.
- We grant the attendee a non-exclusive, non-transferable licence to use the course materials internally for their own professional or business use.
- Course materials must not be copied, sold, sublicensed, publicly distributed, or used to create competing training products without our written consent.
- Attendees must not record the course without our written consent.
7. Privacy
- We collect and use personal information to manage bookings, deliver courses, issue invoices, send course communications, and provide related customer support.
- Our handling of personal information is set out in our Privacy Policy.
8. Consumer law and liability
- Our services come with guarantees that cannot be excluded under the Australian Consumer Law.
- To the extent permitted by law, and subject to any rights that cannot be excluded, our liability for any claim arising out of a course or these Terms is limited to re-supplying the course or refunding the course fee.
- We are not liable for indirect or consequential loss, including loss of profit, revenue, opportunity or goodwill, except where liability cannot lawfully be excluded.
9. General
- These Terms are governed by the laws of New South Wales, Australia.
- If any part of these Terms is unenforceable, the rest continues to apply.
